Right to compensation

If you are denied boarding or your flight is cancelled 3 hours (except in the event of Force Majeure), you are entitled to the following compensation:

  • EUR 250 for all flights up to 1500 km; or
  • EUR 400 on all flights more than 1500 km within the EU/EEA and on all other flights between 1500 km and 3500 km.

If Niceair is able to offer an alternative route or alternative flight where the arrival time by the other route does not exceed the scheduled arrival time for the booked flight

  • By 2 hours for flights of 1500 km or less; or
  • By 3 hours for flights in the EU/EEA of more than 1500 km, and for all other flights between 1500 km and 3500 km

the compensation specified above may be halved. Distances are measured using the great circle route method.

Right to refund or right to an alternative route

In the event of (voluntarily or involuntarily) being denied boarding, or if your flight is cancelled, you also have the right to choose from:

  • A refund within 7 days (Section 8 of the Regulation, provided by methods set out in Section 7 of the Regulation, of the whole fare paid, for part or parts of the journey that did not take place; for part or parts that have already taken place if the flight(s) no longer serve(s) any purpose in relation to the passenger’s original travel plan; or
  • An alternative itinerary with comparable conditions of carriage to the final destination as soon as possible, or
  • An alternative itinerary with comparable conditions of carriage to the final destination at later date, as requested by the passenger, subject to availability of seats.

If the flight is delayed by at least five hours and you choose not to travel, you are entitled to a refund pursuant to the first point in this section, and, in addition, where applicable, a return flight to the first point of departure with Niceair at the earliest possible opportunity.

Right to catering

If you are denied boarding involuntarily or if your flight is cancelled or is delayed by more than 2 hours, you are entitled to:

  • Food coupons for use at the departure airport, in reasonable relation to the waiting time, provided that distribution will not further delay the flight; and
  • A hotel stay if accommodation is required (other than existing requirements for a planned stopover); and
  • Airport/hotel (accommodation) transfers.

If the flight is cancelled without prior notice to you before arriving at the airport for check-in, Niceair must, to the best of its ability, offer provision as set out under the first two points in the section above. If the delay/cancellation is such that the flight does not leave until the following day, you are entitled to all the points above. If it is not possible for Niceair to provide one or more of the above points, you can apply for reasonable, verifiable expenses to be reimbursed.
