Was your flight delayed or cancelled?

Here you can find information about your rights, when you are refused permission to board, your departure is cancelled, or your flight is delayed.

This information is about your rights laid down in EU Regulation no. 261/2004 (hereinafter “the Regulation”). The Regulation applies if:

  • You have a valid ticket on a flight operated by Hifly, on behalf of Niceair, at a price that is generally available; and
  • You arrived for check-in before check-in was closed as specified in our conditions of carriage (unless the flight was cancelled); and
  • You were not denied boarding due to the circumstances set out in our conditions of carriage; and
  • You are denied boarding involuntarily, or your flight is delayed by more than two hours after the scheduled departure time or was cancelled; and
  • Your flight is within the EU/EEA or to a country in the EU/EEA (unless you have been compensated, assisted or have received benefits equivalent to your rights under the Regulation).

Delays

If your flight is delayed by more than 2 hours compared to the scheduled departure time on flights of less than 1500 km, 3 hours on flights within the EU/EEA of more than 1500 km, or other flights operated by Niceair between 1500 and 3500 km, you are covered by relevant rights as referred to in point 1 and point 3.

Denied boarding

If the aircraft is overbooked or for other operational reasons there is no space available for a passenger with a valid ticket, we will first try to find volunteers who may be willing, with compensation, to relinquish their seat on the aircraft. If it is not possible to find sufficient seats and you are denied boarding, your rights are as described in point 1 and point 3.

Cancelled flight

If your flight is cancelled, you have the rights as described in points 1, 2 and 3. Niceair may refuse cancellation compensation if:

  • Niceair, on behalf of Hifly, informs you about the cancellation at least 14 days before the scheduled departure time; or
  • Niceair, on behalf of Hifly, informs you of the cancellation between 14 and 7 days before the scheduled departure time and offers you an alternative route that allows you to leave no more than two hours before the scheduled departure time and will take you to your destination less than four hours after the scheduled arrival time; or
  • Niceair, on behalf of Hifly, informs you about the cancellation less than 7 days before the scheduled departure time and offers you an alternative route that will allow you to leave no more than 1 hour before the scheduled departure time and will take you to your destination less than 2 hours after the scheduled arrival time; or
  • Niceair, on behalf of Hifly, can prove that the cancellation is due to Force Majeure (unforeseen circumstances) that could not have been avoided even though Niceair has taken all reasonable measures. Such unforeseen circumstances include weather conditions, safety reasons, strikes, restrictions in air space.
